These Terms of Service ("Terms") govern your use of the timlis mobile application ("the App", "the Service"), operated by Miosga Software UG (haftungsbeschränkt), Chausseestr. 29, 10115 Berlin, Germany ("we", "us"). By creating an account or using the App, you agree to these Terms.
timlis lets you send short predefined or self-written messages (up to 40 characters) to friends you have mutually connected with. Messages are delivered as push notifications. The Service does not store message history: only the most recent message exchanged with each friend is kept, and it is overwritten by the next one.
You must be at least 13 years old to use timlis. If you are under the age required by the law of your country to consent to data processing (16 in Germany), you may only use the App with the consent of a parent or legal guardian.
You sign in with your Apple or Google account and choose a username. You are responsible for activity that occurs under your account. Usernames must not impersonate others or contain offensive content. You can delete your account at any time in the App (Account → Delete Account); deletion is immediate and permanent and removes your profile, friendships, device registrations and the stored last messages.
You agree not to use timlis to:
— send abusive, harassing, threatening, hateful or otherwise unlawful
content;
— spam or flood other users (technical rate limits apply);
— impersonate any person or entity;
— attempt to gain unauthorized access to the Service, disrupt it, or
reverse engineer it beyond what applicable law permits.
You can block any user in the App; blocked users cannot contact you or send you friend requests.
Messages you write remain yours. By sending a message you grant us the technical right to transmit and display it to your chosen recipient — that is the entire purpose of the Service and the only use we make of it. You are responsible for the content of the messages you send.
We may suspend or terminate accounts that violate these Terms, particularly the Acceptable Use rules. You may stop using the Service and delete your account at any time.
timlis is provided free of charge. We aim for reliable operation but do not guarantee uninterrupted availability. We may modify, suspend or discontinue the Service (in whole or in part) at any time; where reasonably possible, we will give advance notice of material changes.
To the extent permitted by law, the Service is provided "as is" without warranties of any kind. We are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit) as well as for injury to life, body or health. For slight negligence we are liable only for breaches of essential contractual obligations (Kardinalpflichten), limited to the foreseeable damage typical for this type of contract. Liability under mandatory statutory provisions remains unaffected.
We may update these Terms from time to time. The current version is always available at timlis.app/terms. If changes are material, we will inform you within the App. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions of your country of residence remain unaffected.
